“CLUE” – the River Birch version

It was NAAS, and not Colonel Mustard, who launched the River Birch version of CLUE® with this question posted to  Judge Berrigan orders River Birch to file a floor plan with the Court:

Which “team” is it that reviews seized documents and records to cull out the truly privileged, confidential or unrelated documents not covered by the warrant?

Pull a card from the Government’  Opposition to Return of Seized Property and Incorporated Memorandum (scribd format below) and the game begins with this “clue”:

Special Agent Bezet and other agents made every lawful effort to separate what was believed to be attorney-client privileged material for a late inspection by a taint team. As noted in Petitioner’s Memorandum, a “clean team” was on scene to collect items from Peter Butler, Sr.’s office at 2000 Belle Chasse Hwy. 

The Government rolled the dice and submitted clues about “who done it” in  Attachment B to the Warrant authorizing the search of the River Birch office building AKA Exhibit H in the Opposition (text-only Exhibits incorporated with brief in scribd format below):

Yeah, I should lose a turn for overlooking this “who done it” exhibit until now – but, then you wouldn’t see the “room” card I’ve been holding since March 2010:

It takes three clue cards to make a winning guess  and we only have two – the suspect and the room.  Anyone got a clue about the weapon?

Any and all documents, correspondence, letters, notes, memorandums, printouts, records, contracts, communications, writings, billing records, payments, expenditures, agreements, calendars, message books, emails, facsimiles, and electronic communications as they relate to the Request for Proposals issued by Jefferson Parish., Louisiana, #RFP-0176, Responses to the Request for Proposals, bids, and contracts, and any other business dealings between RBL and Jefferson Parish.

Any and all documents, correspondence, letters, notes, memorandums, printouts, records, contracts, communications, writings, billing records, payments, expenditures, agreements, calendars, message books, emails, facsimiles, and electronic communications as they relate to any legislation, or proposed legislation concerning the Gentilly Landfill.

Talk about a weapon!  A pocket full of public officials and contractors could definitely deliver a death blow – but speaking of pockets, take a look at this photograph from the Government’s “tour guide” before you put your envelope of cards on the table. Is this the pocket?

  1. The “taint team” must be the answer to my question. They are to make sure the whole process doesn’t become tainted with fruit from a poisonous tree.

    Secondly, before getting into facts and issues it’s worth noting what a well written piece this is. The whole line of writing on this issue has been great. There I said it, it had to be said after all.

    As to the “teams” NAAS, there’s more in the Government’s opposition brief. One thing for certain is the government came prepared and appears to have been extremely careful to stay within the limits of the very broadly defined search as well as extremely careful about the handling of sensitive information.

  4. What sparked my interest more than the shirt is what the shirt is hanging on. Seems to be a fixed ladder with a rope that possibly operates an access door above. Where does that lead???

Are you fucking SHITTING me? “Taint”, according to Webster’s is the territory between the genitalia and the anus, and probably covered in shit, piss or both, depending on the hygiene of the person whose “taint” we’re talking about. And since my prosecutor, AUSA Gregory Kennedy, also ran the execution of the search warrant at the River Birch offices, I’ll let “The SLABBED Nation” decide how “clean” or “dirty” this “Taint Team” was or is. One thing I can predict from personal experience with the U.S. Department of “Injustice” since 8/29/05: When instructed by Berrigan to do something, THEY WILL LIE.   6. There’s more than just Pierre’s dry-cleaned shirt hanging there. There’s also a pair of pants, presumably Pierre’s as well, and some other shirts. I bet that Shop-Vac is full of wet wood, or wet cash.

  7. I think that’s simply an extension ladder leaning against the wall. It’s the kind that has a rope for extending one half of the ladder.

    There does appear to be at least one box of something behind the plenum on the right, with what look like “video” or DVD cases on top. And, the 2 black “boxes” sitting atop the electrical panel may be something.

  8. I know this is getting ridiculous, but NAAS, I don’t think that’s an extension ladder. It would have to be one section of an extension ladder, but I don’t know of any extension ladders (even half) that could fit in such a small space.

    Maybe a helicopter could land on the ladder.

    Rick Buller, an engineer with the Jefferson Parish Landfill, said untreated sludge waste is incinerated before it is accepted.

    As for the burning smell at night, Buller said, it is a simple procedure of clearing the land of brush piles.

    The piles are burned in the daytime but continue to smolder overnight. Ninety percent of the area is now cleaned, he said.

    Marnie Winter, director of the Jefferson Parish Environmental Affairs department, assured residents that the odor will be reduced soon.

    Jefferson Parish officials are monitoring the landfill operation and will report any development on its gas-collection system, implement an odor-control program that will neutralize or mask the odor, and use enzymes to break down odors. A device called the Nasal Rangers also will be used to aid in measuring the level of odors.

    Parish officials will look into alternate covers for the landfill.

    CDM , a company hired by Jefferson Parish, will research different strategies to rid the community of the smell, Winter said. CDM also will evaluate incoming waste loads and sludge.

I’m a “simple” person, but still having more than a little “trouble” focusing on simple things, like “Did the Government exceed the scope of the search warrant, and seize things they shouldn’t have seized when the warrant was executed at the River Birch office?” and “Did Government do what Berrigan told them to do, and return all illegally seized items from the River Birch office?”.     Its only the tip of the iceberg but should illustrate to the DOJ and FBI just what the Birchers are doing not just in Jefferson but in surrounding parishes.

    On that point, you might recall that the mob in New Orleans started in the French Quarter. It was largely a Sicilian immigrant (often impoverished) neighborhood essentially at or around the turn of the 20th century.

    The Marcellos emerged from that milieu and among other things had their own produce company, Pelican Tomato, Imperial Meat, they ran La Louisiana restaurant, etc. The name Marcello turns up almost 500 entities in the LA SOS database.

    Well if you look up the Marcellos’ ownings in the Orleans assessors and LA SOS online databases you will see they have a LOT of property in the French Quarter to this day. One such property, owned by Vince Marcello (who is around town in a variety of “endeavors”) is Maximo’s Restaurant.

        Letten has declined to give an opinion on the bill, which would have given investigators five days after a public body receives a request for subpoenaed records to block the records from being released.
