Breaking: Judge Barbier tosses most of the Vandenweghe suit, Whistleblower claims survive.

Folks I was headed out the door when I found out. I have read Judge Barbier’s order (on the quick) and sent out an inquiry. The whistleblower claim survives.  I’ll have the order and reasons when I get back.

  1. It appears JP politicos have escaped the majority of persecution claims in yet another JP employee persecution case due to what seems to be another error on prescription jurisprudence interpretation. That is unless an effective appeal is in progress to the U.S.Fifth Circuit to the contrary.

    Mr.Theriot, as a State employee, also seemingly defamed John Rombach when Theriot wrongly alleged Johnnie had done certain unethical things when Johnnie worked as a La. financial advisor. John was forced to leave his State position due to Theriot’s alleged ethics violations.

    But John’s attorney also waited in jurisprudence error until the ongoing and delayed Administrative Ethics hearings several years later proved there to be no evidence that Johnnie acted unethically on all alleged counts. As a result, Johnnie’s seemingly correct defamation suit was also dismissed via prescription. and never tried on the merits

    Seems the only thing that will save the day for any remaining AMV claims would be disclosure or testimony by another insider whistleblower that would reveal AMV in fact was fired not due to poor work performance or adverse political allegiance. But rather very possibly because she refused to play “Play Along to Get Along” and was just too honest for service in JP government to keep around.

    Will an insider/s come forward and declare the TRUTH or will everyone continue to “Play Along to Get Along” game.

    Since JP still has no Office of Inspector General that insider would have to call the fairytale John Young Hotline which has pledged to get right on it. Unfortunately, the odds of that happening is slightly greater than the current Vegas line that the world will end in December 2012.

    1. Actually Lockem the JP politicos have escaped nothing. The claims Barbier left in tact will garner discovery plus I think the case facts will support AMVs allegations. I personally would love to see the videotaped depo of Mini Me Roberts explaining his 5 AM terlit habits. 😉

      The post title indeed makes it sound as if AMV got her ass kicked. She waited too long to assert many of her legal claims and that fact bit her, but the claims that survived are the meatiest in terms of money IMHO.

      I’m going to go out on a limb, put my Carnac the Magnificent hat and say my predictive answer is “settle”. We’ll see.

  2. I agree, as discovery itself has risk/Pandora’s box value to JP and therefore $$$$$$$ value to AMV, yet considering attorney costs in terms of investment work time for trial, to prove her firing was solely because she was a whistleblower,that may not necessarily be so profitable $$ return.

    I’ll go further than Carnac and say it’s executive session time very soon, though I would love to see what evil flies come out of Pandora’s Box and Chrissy’s new Area 51,motorized 4G terlit with mister/blowdryer on video with theme Song “Highway to Hell” playing on his $$$$$$$ audio speakers:
