bifucation dysfunction – State Farm issues Subpoena Duces Tecum to Scruggs Law Firm in Rigsby qui tam

Frankly, the Subpoena Duces Tecum issued to Scruggs Law Firm appears to be nothing more than additional evidence State Farm suffers from bifucation dysfunction.  SLABBED reported the symptoms when they first appeared in the Company’s Motion to Compel in Forked! “Bifurcation for Dummies” (part 1 and part 2)

In that regard, Butler Snow attorney Jeffery Walker’s qualified “requests” beg the question, If you can’t compel it, can’t you at least look it up yourself instead of playing with your (sub)poena?

“If any responsive  Document(s) has been produced to State Farm in connection with McIntosh v. State Farm Fire & Casualty…rather than reproducing it in response to this subpoena, it will be sufficient to cite the Bates number or other identifying label in response to the particular request.”

Bless his heart.  Anyone following Katrina litigation knows State Farm must really, really be needy to keep forking around Judge Senter’s Order limiting the first trial and related discovery to the merits of the Rigsbys’ claim of fraud for the Company to ask Scruggs to make a list of what they already have and drop in the mail:

All Documents concerning the sale of Kerri Rigsby’s house to Robert Oswald.

All Documents concerning (A) any communications between (i) Senator Trent Lott and (ii) Scruggs Katrina Group or Scruggs Law Firm and (B) which relate to Cori (Moran) Rigsby, Kerri Rigsby, Brian Ford, Thomas or Pamela McIntosh, or this False Claims Act action.

All Documents concerning (A) any communications between (i) Congressman Gene Taylor and (ii) Scruggs Katrina Group or Scruggs Law Firm and (B) which relate to Cori (Moran) Rigsby, Kerri Rigsby, Brian Ford , Thomas or Pamela McIntosh, or this False Claims Act action.

All Documents concerning any examination, repair, or forensic analysis or examination of Kerri Rigsby ‘s computer.

All Documents concerning any travel or other expense reimbursement to Cori (Moran) Rigsby or Kerri Rigsby by Scruggs Katrina Group or Scruggs Law Firm.

All Documents concerning any communications between (i) Brian Ford and (ii) Scruggs Katrina Group or Scruggs Law Firm.

All Documents concerning any agreement by Scruggs Katrina Group or Scruggs Law Firm to defend or indemnify Cori (Moran) Rigsby or Kerri Rigsby in any way from civil or criminal claims, charges, investigation, penalties, fines, judgments or settlements.

How quickly – and conveniently – State Farm has forgotten Judge Walker’s kinky Order issued October 2007.  I suppose bifucation dysfunction does that to a Company that can’t get a legitimate defense up.
