Indictment?? Here at Team Fazzio we wipe our ass with indictments….

Fazzio appeared relaxed as he sat next to his wife while waiting to be arraigned. When one of his attorneys asked Fazzio if he needed a copy of the 13-page indictment, Fazzio joked that he already had a copy mounted in a scrapbook.

You folks reckon he already knows the names of the would be jurors? Well either that or Fazzio went to Mark St Pierre for advice on how to act in the courtroom.

The Fazzio indictment hits PACER. Looks like the man is in a heap of trouble to me.

Folks, organized crime operate a myriad of scams the only common denominator being garnering ill-gotten loot at the end.  Paul Rioux at the Times Picayune outlines a time-honored scam in the construction industry albeit taken to its most brazen level as Fazzio is alleged in the his indictment to fictitiously billed Garner Services around $1MM with the help of Garner COO Mark Titus.  Normally the way this scam works is a rogue employee of the contractor will assist a subcontractor in getting inflated bids by circumventing the procurement process and a kickback is paid at the end to the rogue employee by the sub in question.  According to the government Fazzio and Titus took it to a whole new level and indeed having the COO of the contractor running the inside interference certainly helped that illicit process.  I’ll add that Garner needs to work on its internal controls because hiding the payments likely involved cost shifting and other nefarious construction accounting tricks.

Of course the government has some time-honored tricks of its own and to the extent Fazzio is ass deep in business with Team River Birch and its management team of Fred Heebe, Jim Ward and his bro Butch (now stinking up the coast) squeezing his balls may be an easy shortcut to getting more dirt on the doings at River Birch, which we already know stinks worse than the landfill on a summer day and  Fazzio certainly knows where all the bodies are buried.

When I get back to my office later today I’ll try to dig up the indictment via PACER but in the meantime Rioux’s story is well worth the read.

We have a Butch Ward sighting and it isn’t good for Gulfport or the coast.

I have a few observations to make concerning Anita Lee’s front page story for the Sun Herald today. One observation is that Councilwoman Cara L. Pucheu of Ward 7 whose district is proposed to expand into a commercial area with few voters can only mean a few things none of which are complimentary to Pucheu, who is evidently either a stooge to Mayor George Schloegel or sold out to the Ward family a la former Gretna City Councilman Jonathan Bolar, now a resident of the Grey Bar Hotel at Club Fed.

The folks in Gulfport City government must certainly be ignorant of the massive federal corruption probe which is happening one state over in Louisiana with Team Ward at its epicenter or they would never be toting water for this notorious family. I’ll add that Holmes-Hines does no one, especially her constituents, any favors by serially playing the race card as this is not a matter of black and white. The color here is $olid green folks.

We’ll have more on this as Slabbed answers the question recently posed to me by a Jefferson Parish politician “What’s it to you”? If only the corruption in Jefferson Parish would stay in Jefferson Parish that’s what.

Criminal Malfeasance, as defined by the Legislature and understood here in Jefferson Parish, has a dual definition:

FIRST THE LAW… apparently enacted to stay in a book and not be applied:

1) RS 14:134 SUBPART F. OFFICIAL MISCONDUCT AND CORRUPT PRACTICES

§134. Malfeasance in office

NOTE: §134 eff. until Aug. 15, 2011. See Acts 2010, No. 811, §1.

Malfeasance in office is committed when any public officer or public employee shall:

(1) Intentionally refuse or fail to perform any duty lawfully required of him, as such officer or employee; or

(2) Intentionally perform any such duty in an unlawful manner; or

(3) Knowingly permit any other public officer or public employee, under his authority, to intentionally refuse or fail to perform any duty lawfully required of him, or to perform any such duty in an unlawful manner.

Any duty lawfully required of a public officer or public employee when delegated by him to a public officer or public employee shall be deemed to be a lawful duty of such public officer or employee. The delegation of such lawful duty shall not relieve the public officer or employee of his lawful duty. Its so on: Fred Heebe lawyers up with some of DC's finest criminal defense lawyers

All three new lawyers added to Team Heebe come from the Washington DC based firm of Williams and Connolly. The recently issued order admitting Tobin Romero Pro Hac Vice is identical to the ones admitting Brendan Sullivan and Robert Cary. Whadda you folks reckon the combined hourly rate of these 3 gents adds to?  I’m thinking somewhere close to $2,000/hour.

The ‘Little Man’ Uncle Carlos (as in Marcello) must be all a glee in his grave to think that the political elite of Jefferson Parish have chosen as their persona, wannabe wise guys, just like his ‘family’ of the past.

And what about this thing, this MAFIOSO thing, that attracts our Parish politicians: from Judge to Parish President, from Council member to Clerk of Court, from a Chief of Police to School Board member, from Mayor to State legislator? Jefferson Parish’s Political establishment’s shocking and disturbing characterization of themselves, both in public projection and by emulating the “Thug Mentality” associated with a mafia family does in fact identify these individuals with what the adopted analogy implies, ORGANIZED CRIME!

Simply stated another way, we have a entrenched, incestuous, arrogant, self-entitlement, retirement junkie Politico Class that do what they ‘wanna do…whatz youz going to do about it?’

Modular News generated on demand: Waste Management and the Parish are still holding hands…..

Folks monitoring a PACER docket is sometimes an interesting exercise in compare and contrast. For example earlier this week Paul Rioux at the T-P wrote a PACER based story on the latest newsworthy developments on the Parish’s suit against Waste Management. The long and short of it is both parties want the July 11 trial postponed as their mutual love and affection continues to grow. But there was something in Rioux’s story that bothered me to the point where I pondered the subject matter over the past couple of days before writing a post on the topic. Two sentences in two paragraphs in fact:

Young’s administration had not responded by Tuesday evening to a request for information on how much the suit has cost the parish. Margie Seemann, vice chairwoman of Citizens for Good Government, said the parish’s response to her recent public records request pegs the legal bill at $250,000.

Seemann has repeatedly urged the parish to drop the suit and cancel the River Birch contract. But parish officials have said they are continuing the suit in hopes of obtaining a court order declaring the River Birch deal null and void.

Henry Mouton cops a plea. Agrees to help Feds in the case against Team Heebe/Ward/River Birch

This is old news by now folks. In reality nothing much happened today except that the marriage between Teams Letten and Mouton was made official today by Judge Martin Feldman. If Mr Mouton delivers the goods as expected he will get off very light. Game theory has a very good explanation of what lead us to this point in the concept of Prisoner’s Dilemma. Mouton is the first documented squealer so it is fair to believe he is in line for the best deal from Team Letten.  For Aaron Broussard, Tom Wilkinson, Tim Whitmer and wifey Dawn this may not be perceived as bad news for them but trust folks it is very bad news for them.

With what we’ve seen on these pages about Mouton, if he delivers like we all think he can I personally have no problem with the 50 lashes with a wet noodle concept for him.
