Since we’ve become pOrteous central, how about a Tommy update.

Brown Sims Associate Tommy Porteous

Our readers may recall the comment here on Slabbed which disclosed Tommy Porteous was let go by Baldwin Haspel just before Dad’s impeachment trial.  We are pleased to report the Porteous has landed at Brown Sims as some sort of suped up associate along side Federal Judge Lance Africk’s suped up Brown Sims associate/wifey.

Like they say its a small, small world…….

Did Dick do it? Slabbed examines the case of Turner v Pleasant, Dick Chopin and Tom Porteous.

With a hat tip to a Slabbed reader I was sent a link to a new twist on an old case, Turner v Pleasant that was presided over by impeached (but not yet convicted) LAED Judge Tom Porteous. I hope the Slabbed Nation joins me in welcoming lawyer Dick Chopin here as we begin with a story by Michelle Massey at the Louisiana Record.

A Louisiana couple is asking a federal court to overturn a previous judgment, claiming the presiding judge acted improperly because of his relationship with defense counsel and a witness.

Ada D. Turner and Ronnie Turner filed suit against Neal E. Pleasant, RPIA of Delaware, Neal E. Pleasant Living Trust, The Travelers Insurance Co. and Standard Fire Insurance Co. June 25 in federal court in New Orleans.

The case was previously tried before New Orleans federal Judge G. Thomas Porteous, Jr. without a jury in April 2003. Continue reading “Did Dick do it? Slabbed examines the case of Turner v Pleasant, Dick Chopin and Tom Porteous.”

Defending the indefensible: A Parish of shame. New revelations in the "NAZI" case Simon v Jefferson Parish and Armand Kerlec. A Guest post by Whitmergate.

Asked by McGovern (Simon’s attorney) if he thought a Jewish person would be offended by a supervisor giving the Nazi salute, Kerlec said, “I don’t know whether they would be or not. I mean … I never even thought about whether anybody would be offended by it. There were so many people (co-workers) egging me on all the time that I just figured — I didn’t think about it.

Kerlec also admitted that he probably used the word “n—-r” on the job during his 32 years as a parish employee, but not among black workers. He also acknowledged receiving extensive parish training with regard to racial discrimination and harassment in the workplace, including warnings not to use racial slurs to describe Jews and African-Americans. He testified that he did not know Simon was Jewish until Simon told him.

Not long ago Parish President Theriot found himself characterized as a modern day Nazi, a Fascist, the Hitler of Jefferson Parish whose arrogance laid bare his stupidity; but more disturbingly his contempt for human rights. “TheRiot”, as Theriot was monikered, knee-jerking imprudently and with the questionable advise of counsel, filed suit against the blogosphere. Having his feelings hurt regarding criticisms of his presumed political stature, TheRiot, salivating to find out the identify of the anonymous commentators, ran into the 1st Amendment wall of Free Speech. Very shortly thereafter, TheRiot dropped the lawsuit, put his head between his legs and waddled off with and holding the hands of his similarly entwined lawyers at Phelps, Dunbar. Breaking: AROD crosses paths with Judge Lance Africk. Detention hearing scheduled for Friday.

Yesterday evening we received word that things are heating up against in USA v O’Dwyer and sure enough a check of the docket revealed a couple of motions filed by Team O’Dwyer.  I’ll circle back to those but first there was something else on PACER that seemed a bit odd so we must get some background courtesy of Nowdy:

Entry below made on 18th but when you click on docket number screen comes up with “You do not have permission to view this document.”

Summons Issued as to Ashton R O’Dwyer, Jr (jtd) (Main Document 54 replaced on 5/18/2010) (jtd). (Main Document 54 replaced on 5/18/2010) (jtd). (Entered: 05/18/2010)

What’s interesting about it is that clearly there appear to be three versions of the summons issued (but no reason given for replacing twice).

Ashton solved the mystery for us on the summons so here is the very short version of what’s up: Continue reading “Breaking: AROD crosses paths with Judge Lance Africk. Detention hearing scheduled for Friday.”

Cruising the coast with Butch and Baby Butch Ward: Poor, poor, pitiful me

Jerard Ward / The Sun Herald

I’ve had one of those famous Slabbed moments of serendipity where events have connected thus I feel compelled  to write a post on the topic especially when news stories which I’ve been holding close marry well with seemingly unrelated events and involve the Slabbed Nation’s Jefferson Parish Branch.

Let’s do this chronologically and go back to last month to begin with our post on the MDOT Port Connector Road and the related eminent domain issues as it involved the Ward family landholdings along I-10 in Gulfport:

The environmental agreement MDOT reached with federal agencies would forever end proposals for commercial development just south of I-10 between U.S. 49 and Canal Road. The agreement also would allow MDOT to go forward with construction of a state port connector road from I-10 to U.S. 90, a route crucial to the port’s plans for expansion. The road would destroy 162 acres of wetlands. In exchange, MDOT plans to buy and place 1,638 acres in perpetual conservation easements. The state Department of Marine Resources would own the land, but about 447 acres on both sides of Turkey Creek would be managed by a nonprofit, the Land Trust for the Mississippi Coastal Plain.

Enter Mayor Schloegel who is concerned over the impact to the city’s tax rolls:

Schloegel said the Ward family, who owns about 1,000 acres of the land, had plans to open Creosote Road south of I-10 from Prime Outlets west to Canal Road.

“It’s my understanding that a good bit of this area is in a wetlands zone, but also that there is approximately 400 acres that is high and dry,” the mayor said….

As our Jefferson Parish friends well know the Ward family is used to getting what it wants. In Louisiana they own (or at least rent) every NOLA area pol down to Mr Mayor Elect himself so it would naturally follow they would aggressively try to protect their investment and vision for the wetlands in Turkey Creek area but I’ll admit to being a bit surprised when less than a week later Anita followed up with another story, this one originating from the Sun Herald building itself as Mayor Schloegel brought a new Ward into the picture, Jerard “Baby Butch” Ward to plead his daddy’s case and it is there we stop next:

An owner of about 1,100 acres south of Interstate 10 says he is the victim of a “federal land grab.” Continue reading “Cruising the coast with Butch and Baby Butch Ward: Poor, poor, pitiful me”
