Meantime here in the 5th Circuit there is no shield for Journalists in criminal investigative matters

Everyone that remembers the recent donnybrook US Senate election and Twitter should know Chuck Johnson, a journalist hailing from California that was a McDaniel partisan. Chuck has been in the news off and on up in central Mississippi for the past several weeks and I’ve kept my eye on it. It looks like Chuck received a grand jury invite and posted same to Twitter for a short time.

Grand juries are serious business.

  1. I guess my question is can they actually make Johnson produce those items or can he claim First Amendment protection? He should not have posted the existence of the investigation, however.

      1. Indeed, worse than that, Doug. Even if a grand jury is purely engaged in a fishing expedition, absent a DA actually stating in the open that he’s out to get “X” and is doing so as pure retaliation, the Supreme Jesters have immunized such actions. Thus no cause of action = no judicial relief.
