So, I guess the question that must be asked, unless this abomination is reversed by a “Higher Court”, is whether the illegally seized items can be used AGAINST criminals, and whether any illegally seized items become “the fruit of the poisonous tree”, immunizing criminals from prosecution. WAY TO GO U.S. ATTORNEY’s OFFICE! Ashton O’Dwyer a/k/a “The WHITE Henry Glover”.

  2. Ginger honey I read Letten’s brief and when there are multiple businesses at one address and no interior doors indicating individual businesses how is seizure of all documents a violation.

    The Heebe’s designed their offices in that special way to be FBI seizure proof but the toothpaste is out of the tube.

    Appeal the decision so the agents can have more time to read about ALL the corruption.

    Uncle Heebe will be right over Ginger to bring some presents for all his precious nieces and nephews, to repair your vehicle, paint your fence and only God knows what else.

  3. That ruling is complete BS. I read the Memos from both sides, and if there was no discernible boundary in the offices on a particular floor, as it seems was uncontroverted, then any evidence seized was fair game. I am astounded, in addition to being angry!

  4. Holy Toledo! An inartfully drafted Search Warrant by people who should know better. Then failure to argue “exigient circumstances” coupled with failure to argue the “crime-fraud exception”. Then they LOSE to Berrigan (Was there any oral argument? Is the transcript available yet?). This is out of my field, but as “Bayou” has suggested, it could be a Merry Xmas present to some politically-connected people in Jefferson Parish, courtesy of “Uncle Sugar”.   6. As much as I dislike the ruling and it was expected from Berrigan, the plaintiffs’ pleading was far better than the Govt.’s. And I think all of us as lawyers, or former lawyers, must consider the seizure of attorney-client materials.

  7. Folks I can think of two reasons why this is utter bllshyte:

    1. The Bill jefferson rulings on evidence seized from his Congressional office. If I recall correctly the DC district or appellate court permitted an in camera and/or agreed upon independent filtering to prevent privileged materials from getting into adversarial hands improperly.

    2. The Eastern District’s very own rulings on evidence seized in the Greg Meffert / St. Pierre cases. Like RB & Heebe Inc. Meffert and St. Pierre had a web of interlocking corporations and entities, owned by the same people, operating off the same real and virtual spaces, basically indistinguishable from each other.     If Heeb Inc. gets away with this because they just happened to light upon the right judge then Meffert and St. Pierre have a mighty big complaint and they should immediately run down the halls waiving this judgment, but alas too late for them.

    Idiocy is truly the enemy of justice that’s for sure.

    I had no idea Berrigan was such an idiot, but wow is she by the looks of things.

  8. All I’m talking about is Butler’s stuff, and Tele makes a good point; it could have been done in camera. But I don’t think anyone reading the pleadings could argue that the Govt. did a better job.

  9. Sock – Maybe Mr Kennedy needs to lighten his workload by ditching the useless bs work aka USA v O’Dwyer.

    Either Mr Letten has a king size woody for AROD or whoever is calling the legal shots on that has some damn good pictures on him.

    With all the public corruption stuff they have going in the LAED you wonder where they find the time.
